Ending a workplace benefit: 5 priority checks in France
Informational guide. An independent qualified legal review has not been completed.
An established workplace custom is a benefit that is general, consistent and fixed. An employer cannot remove it as though it were an occasional favour: withdrawal requires appropriate information for employee representatives and affected employees, with sufficient notice. First establish whether the benefit actually comes from a custom, a contract or a collective agreement, because their procedures differ.

What you leave withA checklist prioritising facts that change the procedure and identifying missing evidence.
Start with the practical sectionWhich five checks matter most?
This ranking follows impact on classification and withdrawal requirements, then the usefulness of evidence for a reply. It does not predict success. Start with the benefit’s origin: a contractual clause or collective agreement cannot simply be removed by withdrawing a workplace custom.
Identify the legal basis
Find the contract, agreement, decision and practice. Withdrawal rules depend on the origin.
Establish the characteristics of a custom
Compare generality, consistency and fixed terms: beneficiaries, recurrence and calculation.
Check who was informed
Examine individual information to affected employees and information to employee representatives.
Examine sufficient notice
The period must allow possible negotiation. No single number of months resolves every case.
Retain dates and amounts
Payslips, letters and delivery records support discussion of future application.

Where does the withdrawn benefit come from?
A custom may arise from a practice with the required characteristics without a document called a custom. Reconstruct beneficiaries, payment periods and the formula. A one-off or discretionary gift does not automatically establish generality, consistency and fixed terms.

How do custom, contract and collective agreement differ?
Use this table to choose what to reread before replying. Recurring payslips are evidence of practice; they do not alone show that every benefit is a custom rather than a contractual commitment.
| Origin | Key evidence | Withdrawal check |
|---|---|---|
| Contract | Clause or amendment | Contract modification |
| Collective agreement | Text and scope | Rules specific to the agreement |
| Workplace custom | General, consistent and fixed practice | Information and sufficient notice |

What does the recurring bonus example show?
In the fictional example, compare years, affected employees and bonus amounts. If a contractual clause guarantees payment, the question goes beyond withdrawal of a custom. If the benefit rests on practice, then examine information and notice.
Fictional example: a bonus uses the same formula each year for one employee category. A general announcement does not by itself prove individual information; the contract and individual notices still matter.

Who should have been informed?
Find the individual communication to beneficiaries and information to representatives. Distinguish announcement from the effective date. An announcement board or meeting does not automatically fulfil the individual information requirement.
- Individual communication and receipt evidence.
- Information to employee representatives.
- Announced effective date and period before withdrawal.

How should you respond if information or notice is missing?
Request the benefit’s legal basis and withdrawal records in writing. A useful reply identifies missing documents before asserting illegality. This page concerns future withdrawal; for an already due but unpaid bonus, use the separate payment-claim guide.

What else should you check?
Does a one-off bonus establish a workplace custom?
No. One payment does not establish the characteristics of a custom. Examine recurrence, beneficiaries and the amount rule.
Does withdrawal always require three months' notice?
No. Notice must be sufficient in context, including to allow negotiation. Three months is not a universal validity threshold.
Can a noticeboard replace individual information?
An announcement board does not automatically replace individual information to affected employees. Also check information to employee representatives.
Is each employee's consent always required?
First distinguish custom from contract. Proper withdrawal of a custom does not necessarily require the consent needed to change a contractual clause.
Does the ranking prove that the withdrawal is unlawful?
No. The ranking organises document review. Assessing withdrawal requires examination of the legal basis, facts and formalities.
Which sources support this page?
Official texts remain in French. The explanations above describe French law. A source check records a reading date; it is not qualified legal review.
