Working on 1 May in France: five pay checks

In France,1 May is ordinarily a non-working public holiday. Where an establishment or service cannot interrupt its activity because of its nature, an employee working that day receives the corresponding wage plus an equal indemnity. This does not authorise every business to open or double an entire monthly salary. Identify the actual work and its pay basis first.

Does volunteering make work on 1 May lawful?

No. Volunteering does not replace the statutory framework for establishments and services unable to interrupt activity because of its nature.

What are the five priority checks?

These five checks follow prerequisite order: establish the date and working framework before examining payroll. They are an editorial priority list, not a statistical ranking of payroll errors.

  1. Identify May 1 work

Keep the relevant hours; a shift crossing midnight needs a verified allocation.

  2. Check continuing activity

The provision concerns establishments and services unable to interrupt work because of its nature.

  3. Isolate corresponding wages

Find wages attributable to the work rather than treating the entire monthly salary as the base.

  4. Check the equal indemnity

Separate the statutory addition from ordinary pay already included.

  5. Reconcile records

The roster, governing agreement and payslip help explain the line and parameters.

Why does 1 May have a special regime?

May 1 is a public holiday on which work stops under a special French Labour Code regime. Not working that day must not reduce salary.

Do not substitute Sunday rules or another public holiday’s treatment. First identify hours actually worked on May 1 and the basis for continuing the activity.

Could the activity legally continue?

The Code permits May 1 work in establishments and services that cannot interrupt work because of the nature of their activity. Normal opening practices or commercial preference do not alone establish that framework.

Identify the basis relied on by the establishment. A remuneration comparison is not permission to employ staff that day.

How should wage and equal indemnity be separated?

Within statutory scope, the employee receives wages corresponding to the work and an equal indemnity paid by the employer. The calculation separates those amounts.

Enter hours and a gross rate already identified. The tool checks neither permission to work, agreement-based premiums nor allocation of an overnight shift.

Separate wages and indemnity

Reconcile stated May 1 hours and wages already included in payroll.

Hours × stated gross rate; equal indemnity within confirmed scope. No premium stacking or permission to work.

Are the eight hours already included in monthly salary?

If the eight hours are already covered by monthly wages, the additional element in the example is the €112 indemnity. Adding the full €224 again would count ordinary pay twice.

The payslip’s presentation can differ. Ask what ordinary amount is already included before comparing totals.

Worked example · fictional facts

Fictional qualifying case: eight hours at €14 gross produce €112 ordinary wage and €112 indemnity, totalling €224 for that work. If monthly pay already includes the ordinary wage, identify the additional €112 separately.

What changes with monthly pay or other premiums?

Monthly payment concerns how ordinary wages are paid; it does not remove the need to identify the May 1 indemnity. Hourly, daily and output-paid workers also have the wage protections specified by the text.

Read each premium or agreement according to its purpose. This page does not automatically stack percentages found in different provisions.

Has the proposed reform already changed the law?

A proposed law does not itself amend the operative Code. The parliamentary page read on 14 October 2026 still described the proposal concerning bakeries and florists, among others, as in progress.

Do not convert an announcement or intermediate vote into current permission. Recheck the enacted text, commencement and actual scope before publication or use.

Which records help explain the payslip?

A useful payroll exchange addresses hours, their basis and the indemnity. Keep permission to work separate from the payslip amount.

Prepare the dated roster, stated rate, payslip and any agreement provision. Professional review can then examine a dispute without relying on a vague ‘double salary’ formula.

What else should you check?

Does volunteering make work on 1 May lawful?

No. Volunteering does not replace the statutory framework for establishments and services unable to interrupt activity because of its nature.

Can compensatory rest replace the statutory indemnity?

Within Article L3133-6, the equal indemnity is additional to corresponding wages. The provision does not allow simple substitution by rest.

Is minimum seniority required to preserve pay?

May 1 wage protection must not be confused with ordinary seniority conditions for other public holidays. Read the special regime in Article L3133-5.

Does a Sunday premium automatically stack with it?

No. Read the applicable provisions and their interaction. The calculator does not automatically stack Sunday premiums and May 1 pay elements.

Do bakeries already have a new general permission?

A proposal or parliamentary stage is insufficient. Check the enacted applicable text; the research observation from 14 October must retain its date.
