Night work in France: worker status, rest and compensation

Informational guide. An independent qualified legal review has not been completed.

Working during night hours is not the same as having night-worker status. The relevant time window and some thresholds depend on the agreement and sector. Night workers receive compensatory rest, with financial compensation potentially added. Record the schedule, then check its classification and the agreement before stating that a particular wage premium is due.

What you leave withA table separating night hours, worker status and documented compensation.

Start with the practical section

What is the difference between night work and night-worker status?

Working an hour at night and having night-worker status are different questions. L3122-5 covers, among other cases, someone habitually working at least three night hours at least twice weekly, or meeting a minimum volume over a reference period under the applicable arrangement.

Which agreement and sector define night hours?

Find the agreement and sector before selecting night hours. The ordinary default period is 9 pm to 6 am, but adaptations and sector-specific rules exist. Do not apply it to every activity or confuse it with on-call or Sunday-work rules.

What do two nights of three hours show?

Two nights of three hours may contribute to the frequency criterion, but the text requires habitual work and the hours must fall in the applicable night period. Retain several weeks of schedules rather than deciding status from one snapshot.

Fictional example: an ordinary schedule includes at least three night hours twice weekly. The page explains the relevant criterion while requiring the night window and sector rules to be checked.

Are rest and a wage premium always combined?

L3122-8 provides night workers with compensatory rest and, where applicable, wage compensation. Rest and a premium are not two amounts automatically combined in every situation. The agreement can specify rights and their implementation.

Which protections and limits should you check?

Also check maximum durations, rest, health monitoring and situational protections. Minors have specific rules. Family-related difficulties may require examining options for a daytime post; calculating a premium does not resolve that issue.

  • Applicable duration limits and rest.
  • Compensation and conditions of day/night transfers.

How can you locate the rule in your agreement?

Request the industry and company agreement references, then locate night-work, compensatory-rest and premium clauses. Compare them with schedules and payslips. A premium on payroll does not prove that required rest has been provided.

What else should you check?

Does the 9 pm–6 am window apply in every sector?

No. Adapted periods and particular sectors exist. Identify the applicable framework before using the ordinary period.

Is a night-work premium required in every situation?

L3122-8 requires compensatory rest for night workers and wage compensation where applicable. Check the agreement rather than inventing a universal premium.

Does a single night establish night-worker status?

One isolated night does not by itself establish status. Examine habitual frequency or volume over the applicable reference period.

Do different rules apply to minors?

Yes. Night work by minors has particular prohibitions and exceptions; ordinary adult rules should not simply be applied.

Can an employee request a change to day work?

Transfer options and priorities depend on the framework and available posts. A request does not guarantee an automatic transfer date.
