French property seizure: seven orientation-hearing checks

At a French property-seizure orientation hearing, the enforcement judge checks conditions and decides how proceedings continue. Challenges and requests need preparation within the applicable procedural framework. Lawyer representation is the ordinary rule, with a narrow exception for requesting an amicable sale. Receiving the first command does not mean that the final sale outcome has already been decided.

Does the small-claim threshold remove the need for counsel here?

Julie Illustration

No. Property seizure has its own representation framework. An ordinary small-claim threshold supplies no general exemption here.

What are the seven orientation-file checks?

These seven checks follow documentary urgency and procedural prerequisites. They organise an orientation file without estimating chances of stopping seizure.

  1. Identify act and hearing

Command, publication and summons are different records.

  2. Clarify representation

Read the lawyer rule and relevant narrow exception before preparing requests.

  3. Collect title and statement

Connect legal basis and sums without treating a total as validation.

  4. Prepare challenges before orientation

    Procedural stage affects admissibility.

  5. Examine amicable sale

A request and judicial authorisation differ from a completed sale.

  6. Keep publicity records

Connect dates, acts and supporting evidence.

  7. List unresolved urgencies

Flag a missing record or recent act to counsel without waiting for the worksheet.

Which act was received and at what stage?

The file may include a seizure command, publication evidence and the orientation summons. Identify each act rather than deriving every stage from the first received date.

Keep complete acts and service details. Missing pages can contain dates or wording absent from a summary.

What role does counsel have in the process?

Parties ordinarily constitute an avocat in property-seizure proceedings unless otherwise provided. Another small-claims threshold does not automatically remove that requirement.

A targeted amicable-sale exception exists. Distinguish it from preparing and presenting other challenges.

Which exception concerns an oral amicable-sale request?

Article R322-17 exempts the debtor’s request for amicable-sale authorisation and prescribed consequent acts from avocat representation. The request can be oral at orientation.

This narrow exception does not remove lawyers from the whole seizure process. Nor does an oral request become authorisation already granted.

Which challenges need preparation before the hearing?

Article R311-5 restricts challenges and incidental requests after orientation, subject to contrary provisions and exceptions. Later procedural acts can use the specific fifteen-day period from notification.

That is not a universal period for challenging every seizure act. Counsel needs stage and precise act rather than an automatic calendar.

How does authorised amicable sale differ from forced sale?

The enforcement judge checks prescribed conditions, decides challenges and requests, then determines continuation. Authorised amicable sale and forced sale have different frameworks.

A proposed price or sale plan is not authorisation. Compare the judge’s conditions and price requirements with the file.

How should title, statement, publication and evidence be organised?

An organised file connects title, statement and procedural acts. A quantified objection does not replace evidence of its basis.

Title
Decision or instrument relied on by the pursuing creditor
Statement
Items and payments to reconcile
Publicity and summons
Acts, dates and hearing
Evidence
Records corresponding to proposed issues

How should the hearing be identified when its summons is missing?

The fictional file has a command and statement but lacks the orientation summons. The checklist identifies the missing act and hearing date; it invents neither.

Another act’s date is not automatically the hearing date. Compare the file with procedural information through counsel.

Worked example · fictional facts

Fictional file: the command and a debt statement are present, but the orientation summons is missing. The checklist identifies the act and hearing date to obtain with counsel; it does not infer them from the command.

Which urgent questions belong with counsel?

Urgent questions concern hearing, recent acts, representation and requests still to prepare. A complete checklist neither stops seizure nor extends a period.

Julie can organise records. Challenge or sale decisions and required representation belong with the competent professional.

What else should you check?

Does the small-claim threshold remove the need for counsel here?

No. Property seizure has its own representation framework. An ordinary small-claim threshold supplies no general exemption here.

Does an oral amicable-sale request exempt every other issue from representation?

No. Article R322-17 concerns the request and prescribed consequent acts. Other seizure steps do not all become lawyer-free.

Is fifteen days the challenge period for every seizure act?

No. The reference concerns a specific later-act branch after orientation. Examine stage, notice and special provisions.

Must the judge approve the proposed amicable-sale price?

No. The judge examines the request and sets conditions. A proposed price is not automatically accepted.

Does a completed checklist guarantee the seizure will stop?

No. The checklist prepares records and questions. It neither suspends seizure, guarantees a decision nor replaces required representation.
