Serve a civil judgment before enforcement in France
Informational guide. An independent qualified legal review has not been completed.
Reading a civil judgment or sending it informally does not always permit enforcement. Identify the decision, required copy and applicable notification or service rules before requesting execution. A judicial officer handles acts within that profession's competence. Service, remedies and enforcement measures are separate stages; an emailed copy does not automatically substitute for them.

What you leave withA pack distinguishing the title, copy, service and evidence needed for enforcement.
Start with the practical sectionWhich judgment and copy should you obtain?
Gather the complete French civil judgment and the copy needed for enforcement. Civil Procedure Code 502 provides an authenticated copy bearing the enforcement formula unless otherwise provided. A PDF received in correspondence does not automatically satisfy that check.
- Complete judgment and operative orders.
- Enforceable copy and notification records.
- Payment or voluntary-compliance position.

Are notification and service interchangeable?
Service by a judicial officer is one form of notification. Not every judgment uses that route: check the decision’s framework. Article 503 ordinarily requires notification before enforcement against the person concerned, with voluntary compliance and particular frameworks distinguished.
| Element | Question | Limit |
|---|---|---|
| Notification | How was the decision notified? | Do not assume officer service in every case |
| Officer service | Which service act is available? | Separate from enforcement measures |
| Enforcement | Which title and measure? | Voluntary payment differs from seizure |

Which task should you prepare for the judicial officer?
Define the mission: serve the judgment, verify existing notification or prepare enforcement. Provide the copy, useful information and evidence, then request fees and returned proof. Forwarding an email alone does not define the whole mission.

What does an emailed copy show?
The example has an emailed judgment and a contemplated seizure. First find enforceable copy and notification framework. The email can identify the decision without alone proving the notification needed for enforcement.
Fictional example: a party receives a judgment PDF and requests seizure. Preparation checks the enforceable copy and notification regime, separating service instructions from the desired enforcement measure.

How do service, remedies and enforcement differ?
Keep three stages separate. Service can affect periods, but this page does not calculate the recipient’s appeal deadline. Remedies, provisional enforcement and exceptions require examination before treating service as general permission to seize.
Service
Identify notification and act evidence.
Remedies
Have judgment effects and periods examined.
Enforcement
Check title, conditions and chosen measure.

Which evidence should you keep afterwards?
Keep the returned act, charges and follow-up alongside payments received. Update balance and information before another measure. Foreign judgments or special frameworks require dedicated rules rather than automatic application of this French civil preparation.

What else should you check?
Must the successful party always arrange service themselves?
Not always. Check the judgment’s notification framework and work already performed; some notification follows another route.
Does voluntary compliance use the same route as seizure?
No. Voluntary compliance can avoid the same route as forced enforcement. Article 503 distinguishes that case.
Does an opponent's email prove valid service?
No. An email can transmit a copy without being the required service act or notification.
Does a foreign judgment automatically use this route?
No. Foreign-decision recognition and enforcement need their own framework. This page concerns French civil judgments.
Does the page calculate the recipient's appeal period?
No. It prepares copy, notification and enforcement mission without certifying the recipient’s remedy deadline.
Which sources support this page?
Official texts remain in French. The explanations above describe French law. A source check records a reading date; it is not qualified legal review.
