Wage deductions in France: advance, overpayment or fine?
Informational guide. An independent qualified legal review has not been completed.
The rules for a wage deduction depend on its reason: a cash advance, overpayment, absence or disciplinary fine. Financial disciplinary penalties are prohibited. Repayment deductions for a cash advance are subject to the one-tenth rule. Identify the reason and amount on the payslip before agreeing repayment terms or challenging the deduction.

What you leave withA note separating the stated reason, advance repayment calculation and evidence to request.
Start with the practical sectionWhat deduction appears on your payslip?
Start with the exact payslip label and the period concerned. An employer deduction might repay money advanced before work was done, correct a duplicate payment or reflect an absence. The word ‘deduction’ alone does not identify the applicable French legal rule.
Ask for a breakdown separating the alleged debt, wages payable and amounts already recovered. Keep the original payslip before any correction: a replacement should not erase the record of what was paid or deducted.
| Stated reason | Useful check | Evidence to request |
|---|---|---|
| Cash advance | Successive deductions: the one-tenth rule | Advance request and remaining balance |
| Overpayment | Actual error and recovery arrangements | Payroll calculations before and after correction |
| Absence | Time not worked and calculation method | Schedule and attendance record |
| Financial penalty | Financial disciplinary penalties are prohibited | Written explanation of the disciplinary reason |

How do you calculate the reference for a cash advance?
The reference below applies only to a stated cash advance. Article L3251-3 limits successive repayment deductions to one tenth of wages payable. A salary instalment for work already performed is different from this advance.
Enter a reference salary, the remaining advance and the proposed deduction. The calculation displays a reference limited by the stated balance. It does not verify payroll, offsetting against another debt or concurrent seizures. An arithmetic result does not authorise a deduction.

Do absence, overpayment and fines follow the same rules?
For absence, check the time actually not worked and the method used. For overpayment, reconstruct the erroneous payment and corrections before discussing instalments. Do not automatically apply the advance calculator to those cases.
Article L1331-2 prohibits fines and other financial disciplinary sanctions. Money withheld as punishment for an error, lateness or damage therefore needs a different check from a payroll correction. Payroll terminology does not replace examination of the actual reason.

How does the €600 advance example work?
This example assumes the €600 was genuinely a cash advance and €2,000 is the relevant wages-payable basis. Payroll must verify those assumptions; the tool does not establish them.
After each deduction, record the amount recovered and the balance. If €450 has already been deducted, €150 remains: a €200 monthly reference does not justify recovering more than that balance. A proposed €250 deduction needs an explanation against the €200 reference.
Fictional example: €600 advance and €2, 000 reference salary give a €200 repayment reference. Three €200 deductions repay €600; the calculation does not verify the salary basis or reason.

What should you ask payroll before replying?
A short request can say: ‘Please explain the deduction’s reason, relevant period, original amount, calculation and repayments already recorded. I would like to reconcile these figures with my payslip before replying.’ Add the month and payslip line to your actual message.
If proposing instalments, separate that proposal from acceptance of every figure. Keep payroll’s reply and request a corrected payslip when an error is acknowledged. An informal exchange does not decide the underlying dispute.
- The relevant payslip and earlier payslips where useful.
- Evidence of the payment described as an advance or overpayment.
- A breakdown of amounts already repaid.
- The written explanation of the salary basis and deduction reason.

What evidence should you keep if the deduction is disputed?
Keep a timeline of payslips, payments, requests and replies. A bank statement proves a payment; it does not by itself explain a deduction. Connect each movement to the payslip and the employer’s breakdown.
If disagreement continues, have the records and legal classification examined before proceedings. For a creditor’s seizure, use the separate wage-seizure guide: its limits and procedure differ from repayment of this advance.

What else should you check?
Is a salary instalment the same as a cash advance?
No. A salary instalment relates to work already performed; an advance pays ahead of work not yet performed. The distinction affects whether the repayment regime in L3251-3 applies.
Can an employer charge a mistake as a disciplinary fine?
Article L1331-2 prohibits disciplinary fines and other financial sanctions. Identify the actual reason first: a payroll correction is not automatically a disciplinary penalty merely because it reduces a payment.
Must an overpayment be repaid all at once?
The advance calculator cannot answer this universally. Check the debt, recovery calculation and proposed terms; request an explicit instalment plan if immediate repayment would cause difficulty.
Must the payslip identify the deduction?
The payslip and breakdown should make payments and deductions understandable. If the label is unclear, request the reason, period and calculation, and retain the payslip version you received.
Does a creditor's wage seizure use this calculation?
No. A creditor’s wage seizure has a different framework. The one-tenth reference here does not replace its statutory scale or procedural documents.
