Split annual leave in France: check extra days

Extra split-leave days in France cannot be inferred from a calendar alone. Under the default regime, qualifying principal annual leave taken outside 1 May–31 October can generate one or two additional working days. First check the governing agreement, the French jours ouvrables unit, exclusion of the fifth week and any valid individual derogation. The counter illustrates only that confirmed default case.

Are jours ouvrés and jours ouvrables interchangeable?

Julie Illustration

No. They are different counting units. The table uses the jours ouvrables specified by the text, without automatically converting a jours ouvrés counter.

Which text governs split leave in the business?

The governing agreement comes before the default counter. A company or establishment agreement, failing that a branch agreement, may set the continuous-block period and splitting rules beyond the twelfth day.

Without relevant terms, the Code supplies the references shown here. Identify any individual derogation too; leave software alone does not establish which rule applies.

What are the five checks before counting?

These five checks prevent counting days outside the regime. Their editorial order follows legal prerequisites, without claiming measured error frequency.

  1. Read the agreement

Find its version and splitting rule, not just the general leave-taking period.

  2. Check the continuous block

Separate principal leave and its continuous portion from scattered days.

  3. Identify qualifying days outside the period

The default reference period is May 1 to October 31.

  4. Exclude the fifth week

Days due beyond twenty-four jours ouvrables do not count for this supplement.

  5. Check a derogation or waiver

An individual agreement can change application of the default provision.

Which outside-period days actually qualify?

Under the default regime, isolate qualifying principal-leave days taken outside May 1–October 31. Check the twelve-jour-ouvrable continuous block.

Do not combine RTT, carried-over leave and the fifth week indiscriminately. A counter supplies a quantity; dates, origin and day-counting units explain what it represents.

Why is the fifth week excluded?

The fifth week does not increase the day count for this default calculation. The text excludes principal-leave days due beyond twenty-four jours ouvrables.

Taking them outside the period does not make them qualifying days for the supplement. Separate counter lines and request an explanation if their origins are unclear.

How does the one-or-two-day reference work?

The default reference gives one additional day for three to five qualifying days outside the period, and two for six or more. Zero to two gives no supplement under this reference.

The tool uses whole jours ouvrables already classified. It does not automatically convert jours ouvrés and withholds the reference where the agreement or waiver remains unknown.

Do seven qualifying outside-period days give two extra days?

Seven qualifying days give a two-day reference in the confirmed fictional case. This assumes the required continuous block, exclusion of the fifth week and no derogation changing the arrangement.

If an assumption is missing, retain the count as file information rather than an acquired entitlement. The same number can describe legally different days.

Worked example · fictional facts

Fictional default-regime case: twelve consecutive days were taken within the period and seven qualifying days outside it, excluding the fifth week. The reference is two extra days, subject to the confirmed conditions and derogations.

Can an agreement or individual derogation change the result?

Yes. Collective terms or an individual derogation may change the analysis. Default rules cannot be assumed simply because leave was taken outside the period.

Compare the provision, request and agreement to split leave. Leave of twelve jours ouvrables or less is continuous; rules for splitting longer principal leave need separate reading.

Which records belong beside the leave balance?

A useful file explains the move from the overall counter to days actually counted. Preserve each number’s unit and origin.

Do three outside-period days have the same result as six?

No. In a confirmed default case, three to five qualifying days give one extra day; six or more give two.

Do RTT days count as principal annual leave here?

No. RTT does not become principal annual leave because of when it is taken. Its regime remains separate from this count.

Can the employee always choose the split alone?

No. Splitting and required agreements depend on the applicable framework. This page does not turn a leave request into unrestricted freedom to split leave.

Can the counter be used without checking the agreement?

No. First identify the agreement and possible derogations. A different or unknown rule prevents presenting the default counter as certain entitlement.
