Parental-presence leave and AJPP in France: days and separate applications
A private employee may take parental-presence leave for a dependent child whose serious illness, disability or accident requires sustained presence and demanding care. The initial reserve is up to 310 working days over three years, within the medical duration. From June 2026, initial employer notice is at least 10 days. Unpaid employment leave and the AJPP benefit requested from CAF or MSA are separate procedures.

Which days remain and which documents need preparing?
Fictional example: initial period from 15 June 2026, 80 days already taken and five planned. The arithmetic balance is 230 days, then 225 after the plan; files and payment remain subject to review.

For each day or half-day, notify the employer at least 48 hours in advance; sudden deterioration or a crisis requiring immediate presence permits immediate leave. Date-only fields do not certify that exact hourly notice. Initial notice is 10 days under the statute effective 14 June 2026, despite the older regulation still displaying 15.
Documents still to prepare: CAF or MSA AJPP form prepared ; Detailed medical certificate in a confidential envelope prepared ; Employer leave-status certificate prepared ; Monthly AJPP-day certificate prepared.
Initial private mainland reserve only, planned absence in 2026. The planned-date check does not cover every day of a multi-day block: compare all dates with the certificate. Mayotte and other employment or territorial regimes are unsupported. No diagnosis, resource test, renewal award or payment amount is determined. Resource documents concern the optional expense supplement, not a general means test for the daily benefit.
When does care for a child qualify for this leave?
A dependent child with a serious illness, disability or accident must need sustained presence and demanding care certified medically. There is no minimum employment seniority. Check actual ongoing responsibility and family-benefit dependency rules: the official page requires a child under 20, the applicable earnings limit and no personal housing allowance or family benefit. The tool asks whether these facts have been checked; it authenticates neither medical nor family circumstances.
The quantified tool covers private employees in mainland France. Public employment, self-employment, compensated unemployment and other territories, including Mayotte, need their own rules reviewed. This is different from parental education leave following a birth or carer’s leave.

How do I notify the employer without mixing ten and fifteen days?
Labour Code L1225-63, amended with effect from 14 June 2026, requires at least 10 days for initial notice. The updated Service Public page uses this deadline. Send a registered letter with acknowledgement or deliver the request against a receipt, enclosing the medical certificate for leave. Keep delivery evidence.
Regulation R1225-14, in its version from 5 February 2024, still displays fifteen days. This dated conflict is explicit: the tool follows the later legislative 10-day rule, without erasing the earlier wording. For an already-open period it does not recalculate a historical initial deadline.
For each day or half-day, give at least 48 hours’ notice. Sudden deterioration or a crisis requiring your immediate presence permits immediate leave. Date-only inputs prove neither the precise delivery time nor urgency.

How do I use the 310 days without assuming automatic renewal?
The initial period contains at most 310 working days for the same child and illness, accident or disability over a three-year window. The certificate fixes the initial duration; the reserve does not authorize exceeding that medical duration. The balance only subtracts declared days already taken and then planned days. It does not check every day of a multi-day absence block.
Half-days and conversion to part-time work require employer agreement. If the reserve or medical duration is exhausted, review renewal with a new certificate: a possible total of 620 days does not mean all families may use them immediately. Exceptional employment-leave renewal and benefit renewal have their own formalities; medical-control approval remains an AJPP condition.

Which separate application goes to CAF or MSA for AJPP?
The benefit application is separate from employer notice. Prepare the official form with the doctor, the detailed medical certificate in a confidential sealed envelope and the employer’s leave-status certificate. CAF or MSA checks the conditions, including residence rules, and the medical-control service gives the required opinion. No benefit amount is inferred from the employment-leave reserve.
A monthly statement records absence days and is completed by the employer for employees. For the same child, the limit is 22 full-day equivalents per month for one or both members of the couple combined, not 22 each. Other benefits may create a non-cumulation issue: declare them to the fund.
The expense supplement requires health-related expenditure and resources below the applicable limit. Resource documents concern this supplement; presenting a general income ceiling as a basic AJPP condition would be misleading. Gathering these records guarantees neither the supplement nor daily payment.

Which limits belong to leave and which to the benefit?
| Limit | Employer leave | CAF or MSA AJPP |
|---|---|---|
| 310 days over three years | Initial working-day reserve, within medical duration | Conditional benefit reserve under its own rules |
| Ten days, then 48 hours | Initial notice and each absence, except immediate crisis | Notice does not award payment |
| Half-days or part-time work | Employer agreement required | Declarations and conditions reviewed by the fund |
| 22 days per month | Not a general monthly cap on leave days | Combined benefit cap for the couple and same child |
| Resources and expenditure | Not a condition of the numeric leave reserve | Records for the conditional expense supplement |
Leave suspends pay for the absence; AJPP does not guarantee salary maintenance. Renewal, sharing and benefit cumulation need separate examination.

Which statute sets current initial notice?
au moins dix jours avant le début du congé.
In English, briefly (our summary, not an official translation): The current statute requires initial employer notice at least 10 days before leave starts, then 48 hours for each day or half-day, with immediate leave for sudden deterioration or crisis. The older regulation still displays fifteen days.
Which records go to the employer and which to the fund?
Keep the two files and monthly statement separate. The detailed confidential medical envelope belongs to the fund’s procedure.
- Document 1
Employer request and leave certificate
Start, expected duration and notice; retain delivery evidence.
- Document 2
AJPP form and sealed detailed medical certificate
CAF or MSA application and medical opinion; the fund decides entitlement.
- Document 3
Employer and monthly statements
Leave status and actual days or half-days declared for payment.
- Document 4
Costs and resources for the supplement
Unreimbursed expenses, tax records and household composition require separate review.
Which misunderstandings can block preparation?
Are leave and AJPP awarded together?
No. Employer notice starts the employment-leave procedure under its own conditions. The benefit needs a separate application and CAF or MSA examination, including the required medical opinion. The counter certifies neither award.
Can I take a half-day without agreement?
Splitting leave and part-time work require employer agreement. Leave entitlement does not establish that agreement from silence. Keep the agreed calendar and respect 48-hour notice, unless the statutory urgency exception applies.
Do both members of the couple receive 22 AJPP each month?
No. For the same child, the monthly cap concerns the combined benefit paid to one or both members of the couple. Leave days and benefit days are separate counters; the fund examines the declarations.
Can I immediately use another 310 days after the first reserve?
Not automatically. Renewal requires its conditions and a new certificate. Employment leave and AJPP have separate formalities, including medical-control approval for exceptional benefit renewal.
Do resources determine every AJPP payment?
The resource ceilings discussed here concern the expense supplement. The daily benefit still requires medical, family, activity and residence conditions and compliance with non-cumulation rules; do not infer guaranteed payment.
