Employee lending in France: agreements and permitted costs

Informational guide. An independent qualified legal review has not been completed.

Non-profit employee lending allows a temporary assignment between businesses. It requires, among other conditions, employee agreement, an inter-company agreement and an employment amendment describing the assignment. In the ordinary case, recharged costs cover the relevant wages, social contributions and professional expenses. Preparation must also address employee representatives, working conditions and the employee's return.

Start with the practical section

Which documents distinguish the three parties?

In non-profit employee lending, the employee remains linked to the lending employer while the receiving company organises the assignment under the applicable framework. Distinguish the companies from the employee: the intercompany agreement and employment amendment contain different commitments.

  1. Lending employer

Retains the employment contract and accounts for costs.

  2. Receiving company

Agrees with the lender and organises reception.

  3. Employee

Consents and signs an amendment describing work, hours and location.

How do you present ordinary-case costs?

In the ordinary L8241-1 case, the non-profit character relates to recharging wages, corresponding social charges and reimbursed work expenses. This sheet adds your three amounts and compares the recharge. It does not verify supporting records or a specific exception.

What must the employee's amendment specify?

The amendment organises the assignment with the employee; the agreement connects the companies. Find duration, employee identity and qualifications in the actual documents, with the cost-determination method. Avoid entering identities in this public draft.

What does the no-margin recharge example show?

In the fictional case, €2,000 wages, €800 charges and €100 expenses total €2,900. A €3,100 recharge gives a €200 difference. That arithmetic prompts clarification of the framework and costs; it is not a final finding of unlawful lending.

Fictional example: €2, 000 wages, €800 contributions and €100 expenses total €2, 900. A proposed €3, 100 charge leaves a €200 difference to explain; the tool cannot classify the arrangement by itself.

What exchanges are needed with employee representatives?

L8241-2 provides consultations and information for the relevant CSEs where present under the applicable framework. Organise these steps before implementation. For Julie review, assemble an appropriate or fictional agreement, amendment and calculation; request missing clauses and evidence rather than a certificate.

How do you organise the end of the assignment?

Plan the assignment’s end and return to the lending company. Statutory safeguards provide return to the previous or an equivalent post; initial refusal must not be treated as misconduct. Trial periods and specific arrangements require their own conditions.

What else should you check?

Can an employee refuse the assignment?

Employee agreement is required. L8241-2 protects refusal against sanction, dismissal or discrimination.

Does the contract with the lending employer end?

No. The contract with the lender is neither terminated nor suspended by the assignment in this framework.

Is a commercial commission part of the ordinary case?

An additional commission differs from the three ordinary cost categories. Check the framework and any exception; a difference alone is not a legal verdict.

Can the parties provide for a trial period?

A trial period may be agreed under L8241-2. Check its conditions and consequences of ending it.

Do special SME lending arrangements follow exactly the same rules?

Specific schemes may contain exceptions. The tool excludes them and does not apply its ordinary addition to those regimes.
