Return of seized property in France: the authority

Return of property held by French criminal authorities depends on the procedural stage and competent prosecutor, investigating judge or court. Ownership evidence is not always sufficient, particularly where the item remains evidence or may be confiscated. A return request, refusal challenge and collection of an already-returnable item are separate stages. Their events and periods must not be collapsed into one deadline.

Does an invoice require immediate release?

Julie Illustration

No. An invoice can support a right, but it removes neither return conditions nor the appropriate decision and arrangements.

What stage has the criminal case reached?

Authority depends on criminal-procedure stage: inquiry, judicial investigation or trial. The service physically holding an item is not necessarily the decision-maker.

Locate procedure references and known decisions. An invoice does not establish the case’s stage.

  1. Inquiry or Article 41-4 framework

    Prosecutor powers in prescribed situations.

  2. Judicial investigation

    Investigating judge under Article 99.

  3. Trial court

Return considered by the seized court under relevant provisions.

Which authority can decide return?

Articles 41-4, 99 and trial rules are not interchangeable. Prosecutor, investigating judge and trial court act within different scopes.

Earlier correspondence does not prove its author remains competent after a new stage. Identify current position before choosing the request route.

What right to the item must be evidenced?

Document the right claimed and identify the item: reference, description and relevant ownership or capacity evidence.

An invoice can support purchase without resolving competing rights or procedural conditions. Connect it to the seized item rather than treating it as a release decision.

Why can evidence needs or confiscation prevent release?

Depending on text and stage, evidence needs, party rights, danger or confiscation can prevent return. Ownership alone does not remove these barriers.

Separate seizure, procedural retention and confiscation. Instruments/proceeds and special regimes need examination against the records.

Which records support the official request?

The official request should identify person, item and procedure with records required by the chosen route. The form and notice do not replace checking authority.

Does a purchase invoice replace a return decision?

In the fictional case, an invoice for a seized computer does not replace a return decision. Stage and authority remain to identify.

The invoice supports an acquisition or right claim; it does not permit collection without appropriate arrangements.

Worked example · fictional facts

Fictional example: a claimant has the invoice for a seized computer but no identified return decision. The file adds procedural stage and the appropriate request; the invoice is not treated as permission to collect it.

How do refusal, silence and collection differ?

Refusal, absence of decision and collecting an available item are separate events. Article 41-4 includes a one-month challenge from refusal notification and a collection month connected with formal notice in its branch.

The six-month unclaimed/unreturned-property mechanism has another starting event, linked to closure or prescribed exhaustion of competence, not seizure alone. Read conditions with the file.

What should be checked when collecting an already-returnable item?

After a return decision, identify service, references and collection instructions. A favourable decision and physical handover are different stages.

Formal collection notice can start its own statutory period. Keep evidence and have difficulties examined rather than assuming a decision preserves the item indefinitely.

Which special situations need separate examination?

AGRASC funds/property and other special mechanisms should not be treated as ordinary collection of an identified item. Check service and framework.

Confiscation or disputed ownership also needs separate analysis. Julie can organise records without deciding that return is available.

Does the prosecutor remain competent throughout judicial investigation?

No. During judicial investigation, examine Article 99 powers. Authority does not automatically remain the same as at inquiry stage.

Do AGRASC-managed funds follow this ordinary checklist?

Not automatically. AGRASC funds/property and special mechanisms need their own process; this page does not decide them.

Do refusal-challenge and collection months start from the same event?

No. A challenge relates to refusal notice; collection may relate to formal notice. Identify the actual event for the applicable branch.

Does this page automatically submit the official form?

No. It helps prepare the request and find sources. No judicial form is automatically submitted from this page.
