Selling precious objects in France: tax and evidence

A private sale of precious metals or qualifying jewellery, art, collectibles or antiques can fall within a French flat tax on sale value. Category, residence, exemptions and evidence change the analysis. Choosing the actual-gain regime requires specific proof. This calculation covers only the confirmed flat-tax branch; it does not invent a complete net-gain rate or automatically choose the cheapest tax treatment.

Is gold jewellery automatically classified as precious metal?

No. Material alone does not turn jewellery into the tax category for precious metals. Confirm object nature and classification.

Which category must be identified before a rate?

Establish the object’s category before selecting a rate: precious metals and jewellery, art, collectibles or antiques do not have identical flat-tax treatment.

The simple calculation concerns an ordinary private sale by a French tax resident with category confirmed. Professional sales, exports and uncertain classification need separate examination.

Covered jewellery, art, collectibles, antiques6%0.5%Ordinary exemption at €5,000 or less, within scope

When does the €5,000 threshold matter?

The €5,000 threshold concerns the covered jewellery/art/collectible/antique category, not precious metals. Do not classify every object solely by its material.

The worksheet assumes one simple classified operation. It decides neither multiple-object cases, other exemptions nor special transactions.

Which value forms the flat-tax base?

Flat tax uses the sale price or prescribed transaction value. It is not applied only to profit.

Separate this base from acquisition price used to examine the actual-gain option. No apparent gain does not automatically remove flat tax.

How are tax and CRDS distinguished in the arithmetic?

The worksheet separates tax and CRDS before adding them. It uses eleven or six percent according to confirmed category, plus half a percent CRDS within the stated scope.

Rounded display does not validate filing-rounding rules. Unknown classification blocks calculation rather than becoming whichever category gives the lowest result.

Which evidence permits examination of the actual-gain option?

The movable-gain option needs the prescribed evidence: acquisition date and price, or holding for more than twenty-two years. An assumed price is not evidence.

The holding allowance has its own mechanism, five percent per year beyond the second under the text. This page calculates neither option net proceeds nor an optimal tax choice.

How is the €520 reference obtained for the fictional €8,000 jewellery sale?

For the confirmed fictional €8,000 jewellery sale, six percent is €480 and 0.5% CRDS is €40, totalling €520. The base is stated value, not an assumed gain.

The same value in the metal branch gives a different amount. That demonstrates classification’s importance without allowing free category selection to reduce tax.

Worked example · fictional facts

Fictional confirmed non-exempt case for a private French-tax-resident seller:€8,000 jewellery in the 6% plus 0.5% CRDS category gives €520 flat-route arithmetic. It neither computes the actual-gain option nor validates classification.

Which cases remain outside the simple calculation?

Professional sales, non-residence, exports or separate exemptions are outside the worksheet’s decisions. Keep object and transaction nature documented.

Even in the simple case, the flat reference does not prove the gain option cheaper or dearer. Compare that option using evidence and the regime applicable to the transaction.

Which notices and records need checking before filing?

Prepare object, transaction and acquisition records before consulting the relevant tax notices. Verify filing and timing for the actual case.

  • Description and category for confirmation.
  • Sale evidence and relevant value.
  • Acquisition date and price or relevant holding evidence.
  • Applicable-route notice and questions on filing, payment and rounding.

What else should you check?

Is gold jewellery automatically classified as precious metal?

No. Material alone does not turn jewellery into the tax category for precious metals. Confirm object nature and classification.

References : 150 VI

Do precious metals also receive the €5,000 exemption?

No. The €5,000-or-less exemption shown concerns the other covered category, not precious metals.

References : 150 VJ

Is flat tax charged only on profit?

No. Flat tax uses the relevant disposal value, not merely value less purchase price. The actual-gain option follows different reasoning.

Can an acquisition price be invented when evidence is missing?

No. An invented estimate is not the prescribed proof. Locate records and have the holding-evidence route examined where relevant.

References : 150 VL

Is exactly twenty-two years evidence of holding for more than twenty-two years?

No. Exactly twenty-two years is not more than twenty-two for this proof route. Distinguish it from holding-allowance calculation rules.
