French payroll tax: VAT scope and employer records
French payroll tax can concern employers not liable to VAT, or insufficiently within VAT under the relevant turnover test, subject to exclusions and special rules. It is not an employee net-pay withholding. Separate liability, the receipt ratio, tax base, salary year and possible relief. One turnover percentage alone is not a complete assessment of the tax due.

Which employer and salary year are being examined?
Payroll tax is an employer and salary-year issue. It is not the employee’s income-tax withholding.
Identify employing entity, activities, VAT position and salary year. Do not apply another year’s rate or threshold without checking.

How does VAT exposure affect the scope?
Article 231’s framework concerns, among others, employers not VAT liable or not liable on at least ninety percent of the previous calendar year’s turnover, subject to applicable rules and exclusions.
This is not a test of VAT paid. Partial VAT, exclusions and group situations need more than a simple VAT-liable checkbox.
| Information | Why separate it |
|---|---|
| VAT liability | Relevant turnover share and period |
| VAT actually paid | Does not replace the turnover test |
| Employer and activities | Possible exclusions and special framework |

Which receipts belong in the applicable ratio?
For partial VAT exposure, the provision defines a ratio using receipts/products not opening deduction rights and total relevant receipts/products, including specified outside-scope items.
Reconstruct the statutory perimeter. Invoice VAT percentages or average VAT rates do not replace this ratio.

Why is the base different from net pay?
The base follows the statutory remuneration definition and CSG reference without the expense reduction specified in Article 231. It is not employee net pay.
Compare pay components and employer regime. This page supplies no universal coefficient converting every net salary into a payroll-tax base.

Which rates and bands belong to the correct year?
The verified metropolitan 2026 salary framework uses €9,229 and €18,423 bands, with 4.25%, 8.5% and 13.6% rates on relevant portions.
Establish year, base and special regimes first. This is neither a net-pay table nor an overseas or special-case calculation.
| Relevant annual portion, metropolitan 2026 framework | Rate |
|---|---|
| Up to €9,229 | 4.25% |
| Above €9,229 through €18,423 | 8.5% |
| Above €18,423 | 13.6% |

Does an €85,000 out-of €100,000 ratio already assess the tax?
The fictional €85,000 stated VAT-taxable turnover out of €100,000 gives 85%. It raises a scope question without assessing the tax.
Activities, exclusions, retained receipts, base and rates remain to verify. Turnover alone does not produce a payable amount here.
Fictional preparation example:€85,000 stated VAT-taxable turnover out of €100,000 is 85%. That ratio prompts review of scope and exclusions; it does not calculate the tax, base or reduction.

When are franchise and reduction rules considered?
Franchise and reduction concern computed annual tax, not gross salary or turnover directly. The framework provides franchise where annual tax is at most €1,200.
Above €1,200 through €2,040, the prescribed reduction is seventy-five percent of €2,040 less computed tax. Keep other regimes or allowances separate.

Which records support review without inventing special-regime calculations?
A useful file enables scope review before rates are applied. VAT groups and other special cases are not treated as ordinary employers.
- Employing entity, activities and salary period.
- Reference turnover, receipts and VAT position.
- Base components and relevant payroll records.
- Earlier returns, exclusions and any group regime.
What else should you check?
Does ninety percent refer to the VAT amount paid?
No. The reference concerns the turnover share subject to VAT within the statutory framework, not VAT money paid to the administration.
References : 231
Are annual tax-relief limits applied to gross payroll itself?
No. Franchise and reduction amounts concern computed annual tax. They are not payroll limits.

Do 2025 salary bands automatically apply to 2026 salaries?
No. Connect rates and bands to salary year and applicable version. An earlier table cannot automatically be copied.

Is a VAT group treated like an ordinary employer?
No. Examine group-specific rules and relevant receipts. This guide does not calculate that framework as an ordinary case.

Should employees subtract this tax from their net pay?
No. It is an employer tax, not income-tax withholding to subtract directly from employee net pay.
