Part-time work in France: priority for full-time jobs

A part-time employee in France seeking full-time work can have priority for a corresponding available position in the establishment or, failing that, the company. Applicable collective provisions may specify the framework and request process. This priority does not automatically create a vacancy or reclassify the contract. Document the available role and how it corresponds to the employee’s position.

Must the employer immediately create a full-time post?

No. Priority concerns an available role within the legal framework. It does not immediately create a full-time position absent from the organisation.

How does vacancy priority differ from reclassification?

Priority for full-time work concerns an available position meeting the provision’s conditions. It does not automatically reclassify the existing part-time contract.

A dispute about hours already worked or contract validity has a different purpose. This guide prepares a request tied to an identifiable vacancy and applicable rules.

Which vacancies fall within the establishment or company?

The text concerns a corresponding job in the same establishment or, failing that, the same company. Another group company’s vacancy is not automatically within that scope.

Identify employer, establishment, hours and actual availability. A similar title on a recruitment site does not alone establish that this priority applies.

How should professional category and equivalent work be checked?

The ordinary framework concerns the employee’s professional category or an equivalent job. Comparison therefore goes beyond the hours count.

Compare duties, classification and required skills rather than inferring equivalence from one common word in two titles. Read any agreement extending the range of roles precisely.

What role does the applicable agreement play?

A company or establishment agreement, failing that an extended branch agreement within the statutory framework, may organise transition conditions and extend certain eligible roles.

It may also set request procedures and a reasoned-response period. Do not replace those terms with an assumed universal national deadline.

What information on available jobs should be found?

The employer brings corresponding available jobs to relevant employees’ attention. Priority concerns available positions; it does not require creating a role for every full-time preference.

Retain the vacancy version and date. If information is incomplete, seek clarification of scope rather than immediately asserting a failure.

How can a request identify a particular vacancy?

A useful request identifies the vacancy, states the wish to move full-time and compares relevant criteria. It can ask for examination of priority and the applicable response framework.

Keep the request, job description and reply. The file should explain what was known when applying, without reconstructing an offer retrospectively.

Does a thirty-five-hour vacancy automatically give a twenty-four-hour employee the job?

Moving arithmetically from twenty-four to thirty-five hours describes an eleven-hour difference. It proves neither a corresponding available role nor appointment.

The fictional case first compares vacancy, establishment and category. Missing elements should remain questions rather than becoming an automatic decision.

Worked example · fictional facts

Fictional file: a twenty-four-hour employee identifies a thirty-five-hour vacancy. The file compares role, establishment, category, agreement and request evidence. The eleven-hour difference alone proves neither availability nor automatic appointment.

Which records help explain the employer’s response?

Read the response with the request, vacancy and priority conditions. A refusal or lack of a position cannot be analysed solely through desired hours.

Have objective evidence and the agreement examined before concluding rights between competing applicants. Julie can organise records; this guide does not select whom the employer should appoint.

What else should you check?

Must the employer immediately create a full-time post?

No. Priority concerns an available role within the legal framework. It does not immediately create a full-time position absent from the organisation.

Does the right cover every company in a group?

No. The ordinary scope is the same establishment or, failing that, company. Common group membership is insufficient.

Does it automatically reach an outsourced position?

No. Outsourced work is not automatically an available role with the same employer. Establish vacancy and statutory scope.

Is there one national response deadline?

The governing agreement may organise process and response. This guide does not assert one national deadline for every request.

Does priority itself decide between competing applicants?

Not automatically. Availability, correspondence and other conditions require examination. A comparison table does not decide between candidates.
