Family loans in France: 5 checks for form 2062

Informational guide. An independent qualified legal review has not been completed.

A private loan may need tax reporting independently of the civil validity of a debt acknowledgement. Check the threshold and annual aggregation of several loans, who must report and the contract's terms. Prepare amounts, dates and repayment schedule for form 2062 or its annex. Tax reporting neither turns a loan into a gift nor proves repayment.

Does a single €5,000 loan exceed a €5,000 threshold?

No. Exactly €5,000 is not strictly above the threshold. Other loans and aggregation rules still need examination.

Start with the practical section

Which five checks come before form 2062?

This ranking follows what changes reporting before completing fields. It concerns tax reporting of a loan, distinct from civil evidence. Multiple small loans should not be examined without their annual scope.

  1. Transfer type

Loan with repayment, gift or another operation: identify the relationship.

  2. Year and parties

Record loans and the relevant borrower or lender scope.

  3. Amount and aggregate

The threshold is strictly above €5,000 with applicable aggregation rules.

  4. Declarant or intermediary

Identify who reports under the framework.

  5. Contract and evidence

Prepare form information and retain transfer evidence.

How do a loan, gift and debt acknowledgement differ?

Form 2062 reports a loan for tax purposes. It does not turn a gift into a loan or replace a contract or debt acknowledgement. Distinguish repayment obligations from transfers without consideration.

When should you examine the amount and annual aggregate?

Examine individual amount and relevant loans during the year under aggregation rules. €5,000 is not more than €5,000; smaller loans can together exceed the threshold. Repayment during the year does not automatically remove a loan from tax preparation.

How do you organise loans before reporting?

The record adds stated amounts while retaining unverified year, parties and intermediary as unknown. It files nothing. Avoid names and contact details on this page; required personal form information belongs in the appropriate actual file.

What do €3,500 and €3,000 in the same year show?

The fictional €3,500 and €3,000 loans total €6,500. Assuming the same borrower and year, examine aggregation for reporting. The total proves neither contract, transfer nor repayment.

Worked example · fictional facts

Fictional example: loans of €3, 500 and €3, 000 to the same borrower in one year total €6, 500. Check aggregate reporting; addition proves neither the contract nor repayment.

Who reports and what belongs in the annex?

Check declarant duties and any intermediary role. Official guidance also describes borrower and lender cases. Use the current official form and timetable rather than treating an old PDF as current. Keep return, contract and payment records separately.

What else should you check?

Does a single €5,000 loan exceed a €5,000 threshold?

No. Exactly €5,000 is not strictly above the threshold. Other loans and aggregation rules still need examination.

Can two smaller loans need combined reporting?

Yes, where aggregation in the applicable scope exceeds the threshold. Do not assess each loan alone.

Does charging no interest remove all reporting duties?

No. An interest-free loan does not automatically remove reporting duties.

Can an intermediary be responsible for reporting?

An intermediary can have duties within the applicable framework. Identify its presence and role before assuming reporting is complete.

Does form 2062 replace evidence of payment?

No. Contract reporting and transfer evidence are different records. Keep payment movements and loan terms.
