Business travel time in France: what compensation?

Informational guide. An independent qualified legal review has not been completed.

Travelling to an unusual work location is not automatically working time. When it exceeds the normal journey between home and the usual workplace, compensation in time off or money is required. Travel between workplaces and some journeys performed under the employer's instructions follow different rules. Start with the journeys concerned and the applicable agreement.

Start with the practical section

Which journey should you compare with ordinary commuting?

Reconstruct the required journey: start, destination and duration. Ordinary home-to-work travel is the comparison for a business journey exceeding normal commuting time. It does not by itself resolve travel between workplaces or the situation of a mobile worker subject to employer instructions.

  1. Ordinary journey

Record a comparable normal duration, rather than an unusually fast day.

  2. Business journey

Separate outward travel, return, waiting and work at the destination.

  3. Context

Identify whether the journey starts at home, an establishment or a client.

Is the journey working time or a compensation issue?

Article L3121-4 distinguishes travel to the place where the contract is performed from working time. Travel exceeding normal commuting time attracts time off or financial compensation. The portion overlapping normal working hours must not cause a loss of salary.

How do you record the difference in minutes?

The tool only subtracts comparable durations. It does not assign an hourly rate or calculate overtime. If the journey is between workplaces, examine its legal classification separately before applying a home-to-assignment comparison.

Travel duration comparison

Compare an ordinary commute and assignment travel in the same direction.

Difference = maximum of zero and assignment minus ordinary travel. No rate, payment or overtime calculation.

What does the 90-minute mission example show?

In the example, ordinary commuting takes 30 minutes and the business journey 90. The 60-minute difference describes excess time, not an amount payable. Money or rest depends on the applicable arrangement and actual circumstances.

Worked example · fictional facts

Fictional example: a 30-minute usual commute and 90-minute business journey leave a 60-minute difference. The agreement determines money or time off; the tool invents no hourly rate.

Which agreement sets time off or money?

Find the company or industry agreement governing compensation. Without an agreement, the employer’s decision follows consultation of the CSE under the legal framework. Request the applicable text, its date and the treatment of travel during scheduled hours.

  • Agreement or decision governing compensation.
  • Company definition of the normal journey.
  • Travel reporting and time-off arrangements.

How should you present the record to your employer?

Prepare a per-assignment record of ordinary time, actual time, origin and destination. Keep invitations, diary entries and instructions; a ticket does not establish the entire duration. Then request the compensation rule, separating travel time from expense reimbursement.

What else should you check?

Is travel between clients an ordinary commute?

Not necessarily. Travel between workplaces may be working time depending on instructions and constraints. It should not automatically be treated as ordinary commuting.

Does a required stop at the workplace change the classification?

Yes, a required stop and tasks performed can affect the analysis. Record the instructions and sequence rather than inferring classification from distance alone.

Does an overnight trip make every journey payable?

No. Staying overnight does not turn every journey into working hours. Separate travel, work at the destination, rest and expenses.

Does this tool calculate overtime?

No. It displays a difference in minutes, without a pay rate or legal classification. It does not decide whether the journey is working time.

What if the collective agreement says nothing?

Check company agreements and any employer decision made after CSE consultation as well. Failing to find a rule does not justify inventing a rate.
