Dangerous work in France: withdrawal, warning and pay

Informational guide. An independent qualified legal review has not been completed.

An employee with reasonable grounds to believe that work presents serious imminent danger to life or health must immediately alert the employer and may withdraw. Withdrawal must not create a new danger for others. Protection against sanctions and wage deductions depends on the statutory conditions; an online checklist cannot determine whether those conditions are met.

What you leave withAn understanding of the criteria and an example factual warning, without an automated recommendation to withdraw.

Start with the practical section

Which facts may show serious imminent danger?

Withdrawal requires reasonable grounds to believe the situation presents serious and imminent danger to your life or health. Describe observed facts: equipment, exposure, defect and timing. An ordinary workplace disagreement does not establish this framework.

  • Severity of the described risk.
  • Possibility of imminent occurrence.
  • Concrete grounds for your assessment at the time.

How can you give a warning without waiting for a form?

Immediately alert the employer or responsible person about the dangerous situation. Do not wait for a form to report an immediate risk. A later written record helps preserve facts, time, recipient and response; it does not replace the necessary warning.

What danger must withdrawal avoid creating for others?

Withdrawal must not create a new serious and imminent danger for others. Where you move and how work is interrupted matter. Document preparation should not be treated as technical instructions for shutting down equipment.

How can you describe defective equipment?

For the fictional defective equipment, record the visible defect, risk and task. Distinguish observations from assumptions. Keep instructions and the warning response. These records support later assessment without certifying here that withdrawal is justified.

Worked example · fictional facts

Fictional example: an employee observes a defective guard on equipment. The warning describes the equipment, observed defect and timing, without a diagnosis or automatic certification of a right to withdraw.

When is pay protected?

L4131-3 protects against sanctions and salary deductions when withdrawal meets its framework. The outcome depends on facts: protection should not be described as automatic for every interruption. A pay dispute requires connecting the grounds, facts and exchanges.

Who can examine a dispute about withdrawal?

If disagreement arises, promptly organise the timeline and evidence for examination by appropriate people. This page offers neither danger certification nor a standard withdrawal duration. In an emergency, protection and warning take priority over using Julie.

What else should you check?

Is the employer's prior permission always required?

L4131-1 permits withdrawal within its conditions. Do not wait for permission to warn of immediate danger. Justification depends on reasonable grounds and facts.

Must the first warning be written?

The text requires warning without making a prior written form a general condition for the first alert. A later written record is useful evidence.

Must the danger affect the whole team?

No. The danger may concern your own life or health. Also check that withdrawal does not create a new serious imminent danger for others.

Is there a fixed withdrawal duration?

No. Duration depends on the dangerous situation and subsequent measures. A fixed number of days does not replace assessment of risk and responses.

Can a tool certify that withdrawal is justified?

No. A checklist organises facts without technically establishing danger or finally classifying withdrawal. Evidence and circumstances require examination.
