Prepare an unpaid-leave agreement in France
Ordinary unpaid leave in France is negotiated with the employer; it is not a general entitlement with one statutory duration or notice period. Collective provisions may nevertheless apply. A written agreement can record dates, renewal and return arrangements. The contract remains suspended. A draft request or lack of response does not automatically establish the employer’s consent.

Which dates and terms need agreement?
Dates, duration and return arrangements need agreement. The absence of a general national notice period or duration for ordinary unpaid leave does not remove the need to read collective terms and the contract.
Separate requested from accepted terms. A return date in a draft does not prove employer consent.
| Term | What the document should clarify |
|---|---|
| Departure and return | Requested dates, then agreed dates |
| Renewal | Possibility, request and agreement to define |
| Early return | Conditions and process to discuss |
| Resumption | Position, pay and arrangements to clarify |

Is unpaid leave an entitlement in the applicable framework?
Ordinary unpaid leave depends on employer agreement, subject to applicable collective terms. Distinguish it from a statutory leave scheme with its own eligibility and formalities.
Identify the requested framework before preparing departure. A request, discussion and actual agreement are separate stages; silence is not treated here as acceptance.

How can a draft be prepared without inventing consent?
The scaffold organises information without concluding an agreement. Departure and return fields remain requests; renewal and resumption terms can remain unresolved.
Read the document with the contract and collective agreement before signature. The tool creates neither a signature, permission to depart nor an automatically sent employer message.

What is missing from a request with unclear return arrangements?
In the fictional file, renewal and the return position remain open. Two requested dates do not fill those gaps.
The scaffold makes questions visible before departure. Zero open points among tracked fields does not establish a complete, valid or signed agreement.
Fictional draft: requested leave starts 1 December 2026 with return on 1 February 2027; renewal and the return position remain unspecified. The scaffold highlights those two open points without turning requested dates into permission.

How should renewal and early return be addressed?
Renewal or early return should follow agreed terms or be discussed with the employer. This page creates no unilateral right to change the date.
Clarify how a request would be made, any response arrangements in the document and what happens without further agreement. An envisaged process is different from consent already obtained.

What happens to the contract during the absence?
The contract is suspended, without ordinary employer salary for the absence. Unpaid leave alone does not terminate it.
Effects on social rights, benefits and their funding need separate examination. A time-savings account does not automatically make this absence paid; its conditions must be checked.

Which protections and activities need separate checks?
Suspension does not remove every contractual obligation, including loyalty. Compare any proposed activity during leave with applicable terms and rules.
Sabbatical and other statutory leave have different frameworks. Do not copy their protections or coverage conditions merely because the proposed absence looks similar.

What should be recorded about the return role and pay?
Useful return terms explain what has been agreed and what remains governed by the employment contract. Describe the position or resumption arrangements without treating a pay change as accepted by default.
Keep the request, response and any signed version. Julie can help identify unresolved terms; a binding decision or dispute about returning requires professional examination.

What else should you check?
Does employer silence authorise departure?
Do not assume so. For negotiated ordinary unpaid leave, an unanswered request alone does not prove that departure was accepted.

Must the employee disclose a personal reason?
Do not turn the ordinary framework into a general duty to disclose intimate reasons. Check applicable terms and limit personal information to what is useful for the exchange.

Is there a national maximum for ordinary unpaid leave?
There is no general national minimum or maximum specific to ordinary unpaid leave. Duration and conditions are negotiated, subject to applicable collective terms.

Can early return be imposed before the agreed date?
Not merely because the employee wishes it. Read agreed early-return conditions and obtain agreement where the change requires it.

Does a time-savings account automatically fund the absence?
No. A time-savings account has its own usage rules. Its existence does not automatically turn negotiated unpaid leave into paid absence.

Which sources support this page?
Official texts remain in French. The explanations above describe French law. A source check records a reading date; it is not qualified legal review.
