Sentence adjustment in France: prepare a JAP file

French sentence adjustment depends on the conviction, execution stage and situation examined by the judicial authority. Rules differ before imprisonment and for particular measures during a sentence. Duration alone does not guarantee an adjustment. The file should make the judgment, obligations, proposed arrangements and evidence readable without simulating the JAP’s decision or delaying professional assistance where it is needed.

Does a sentence below one year automatically permit every adjustment?

No. Connect duration with framework, execution status and conditions. The one-year branch does not guarantee every requested measure.

How do conviction, execution and adjustment differ?

The judgment fixes conviction and sentence; execution and possible adjustment are separate stages. A pronounced duration does not automatically select the measure granted.

Gather decisions and current execution status. This guide prepares records and questions for the JAP and counsel without estimating adjustment probability.

Does the process arise before or during imprisonment?

Pre-incarceration and in-custody routes have different conditions. Identify current position before applying a guide’s duration.

  1. Before imprisonment

Article 723-15’s specified persons/sentences, conditions and exceptions.

  2. During execution

Examine the particular measure, duration or remaining term and regime.

  3. Decision and implementation

A project and evidence differ from an approved measure.

Which durations belong to which measures?

Durations belong to specific mechanisms. Article 723-15’s one-year reference and Article 723-1’s two-year semi-liberty/outside-placement framework are not one threshold for every adjustment.

Compare conditions, exceptions and execution position with the decisions. The verified Article 723-1 version includes the August 20, 2026 amendment.

Which durations belong to which measures?
FrameworkReference with its conditions
Pre-incarceration, Article 723-15Sentence or remainder at most one year within scope
At-most-six-month branchStronger rule and prescribed exceptions, not every measure automatically
Semi-liberty / outside placement, Article 723-1Two-year reference for specified cases and exceptions

What must the JAP and counsel identify?

The JAP and counsel need convictions, custodial portion, execution position and relevant decisions. Article 712-6’s ordinary adversarial process and prescribed participants contribute to decision-making.

Some records, including the bulletin n°1 in the described mechanism, are transmitted by prosecution. Separate that judicial channel from personal evidence the person can prepare.

How can proposed arrangements and constraints be evidenced without predicting the decision?

Support the project with records of actual activity, accommodation and constraints. Employment evidence alone does not establish every measure condition.

Keep useful details in the appropriate channel without unnecessary sensitive disclosure. The file describes the proposal rather than replacing judicial assessment.

Can the remaining term be established when a decision is missing?

The fictional file lacks another decision and execution status. Reliably establishing the remainder is not simply adding known durations.

Flag gaps rather than selecting the apparently easiest measure. Multiple decisions and execution need combined examination.

Worked example · fictional facts

Fictional file: a conviction and employment record are present, but the execution position and another judgment are unknown. The inventory flags those gaps; it calculates neither a remaining term nor an adjustment probability.

Which summonses and stages should be preserved?

JAP/SPIP summonses and prosecution transmission have specific roles within Article 723-15. Twenty- and thirty-day references do not start with any freely sent request.

Keep summons, notice and known transmission evidence. A date already communicated at hearing or a special situation needs its own framework.

Why do urgent or special regimes need separate assistance?

Execution urgency, special regimes or missing decisive records require direct examination with counsel and competent contacts. A filing worksheet extends no deadline.

Julie can organise decisions and questions without deciding the enforceable remainder, release or adjustment grant.

What else should you check?

Does a sentence below one year automatically permit every adjustment?

No. Connect duration with framework, execution status and conditions. The one-year branch does not guarantee every requested measure.

Does the two-year threshold govern every measure?

No. Two years concerns specified Article 723-1 semi-liberty/outside-placement cases, not every adjustment indiscriminately.

References : Code de procédure pénale · article 723-1

Do twenty or thirty days run from any application?

No. Those references belong to Article 723-15’s specific transmission and summons process. They are not a counter from any letter.

Can the remaining term be computed without every decision?

No. Gather decisions and execution status. An unknown decision cannot become an assumed zero duration.

References : Code de procédure pénale · article 723-1 · Code de procédure pénale · article 723-15

Does an employment record alone guarantee the proposed adjustment?

No. It supports one project element, not every condition or the JAP decision. Other constraints and records still matter.
