Annual rent review in France: calculating it with the IRL index

If the lease allows it, French rent can be reviewed once a year, capped by the change in INSEE’s rent reference index, the IRL (article 17-1 of the law of 6 July 1989). New rent = current rent × new IRL ÷ reference IRL. The review only applies once the landlord asks, within one year. For leases signed or renewed since 24 August 2022, an F or G rated home cannot be reviewed.

Must the landlord send a registered letter to raise the rent?

Julie Illustration

The law sets no form: the landlord only has to show the intention to review within the year. A dated letter, such as a registered letter, proves the date of the request, which is when the new rent starts.

What is your new rent after the review?

Enter the rent and pick the index: the tool applies the legal formula, the rent multiplied by the new index and divided by the same quarter’s index a year earlier, and flags the cases where a review is banned.

Answer

Which IRL quarter applies to your lease?

The quarter set in the lease. If it names none, the quarter of the latest index published when the lease was signed. At each review, that quarter’s index, the latest published at the review date, is compared with the same quarter a year earlier.

Service-public’s example: a lease signed on 20 July 2025 at €600, reviewed on 20 July 2026 with the Q2 index: 600 × 148.37 / 146.68 = €606.91.

Answer

Can the landlord raise the rent with no review clause?

No. An annual review only exists if the lease provides for one, and a written lease must set out any rent review rules. Without a clause, the rent stays fixed until renewal.

At renewal, the landlord can only raise it if it is clearly below market, based on reference rents for similar homes nearby.

Answer

Can a forgotten review be back-charged?

No. The landlord must show the intention to review within a year of the agreed date, and the review only takes effect from that request. After a year, the landlord is deemed to have waived that year’s review.

Example: review due on 1 March, request made on 1 September. The new rent is only owed from September, with nothing back-charged for March to August.

Answer

Can rent still rise on an F or G rated home?

No, for leases signed, renewed or rolled over since 24 August 2022 in mainland France, and after 1 July 2024 in Guadeloupe, Martinique, Guyane, La Réunion and Mayotte. Neither the annual review nor an increase for improvement works can then apply.

An older lease, never renewed or rolled over since those dates, keeps the old rule until its next term.

Answer

Does the review also apply to furnished lets and a bail mobilité?

For furnished lets, yes: the same review rules and the same F and G freeze apply, and a flat-rate charge can be reviewed each year on the same terms as the rent.

For a bail mobilité, no: the rent is freely set at the start and cannot be reviewed during the lease.

The law

What does article 17-1 of the law of 6 July 1989 say?

In plain English: Where the lease provides for it, the rent is reviewed each year on the agreed date, or at each anniversary of the lease. The increase cannot exceed the change in the INSEE rent reference index. Without a clause naming the reference date, it is the latest index published when the lease was signed. A landlord who does not ask within a year is deemed to have waived that year’s review, and a timely review takes effect from the request.

Part III of the same article bans any review, and any increase for improvement works, in homes rated F or G.

Frequent questions

What else do tenants and landlords ask?

Must the landlord send a registered letter to raise the rent?

The law sets no form: the landlord only has to show the intention to review within the year. A dated letter, such as a registered letter, proves the date of the request, which is when the new rent starts.

Loi n° 89-462 du 6 juillet 1989, article 17-1

Annual review or increase at renewal: what is the difference?

The review follows the IRL each year, if the lease provides for it. A rent reassessment only happens at renewal, if the rent is clearly undervalued: the landlord proposes it at least six months before the term, with at least three reference rents, six in large cities, and the increase is then spread over several years.

Loi n° 89-462 du 6 juillet 1989, article 17-1Loi n° 89-462 du 6 juillet 1989, article 17-2

What can you do if the rent rose beyond the IRL?

The excess is not owed: the increase cannot exceed the IRL change. Ask in writing for the correction and a refund; the claim is time-barred after three years. For a dispute under 5,000 euros, conciliation, mediation or a participatory procedure must be tried before going to court.

Do service charges follow the rent review?

No. Service charge advances are owed against proof of the actual costs and do not follow the IRL. For furnished lets, a flat-rate charge can however be reviewed each year on the same terms as the rent.
