Clerical error in a civil judgment: prepare the request

Informational guide. An independent qualified legal review has not been completed.

A clerical error or material omission in a civil judgment may be corrected under Article 462 of the Civil Procedure Code without changing substantive rights and obligations. Distinguish this from a claim left undecided or disagreement with the judgment. Reconcile the disputed wording and case-file evidence; identifying a difference alone does not establish that clerical correction is the appropriate route.

Is disagreement with the awarded amount always a clerical error?

No. Disagreement with valuation can concern the merits. Distinguish transcription error from a challenged decision.

What you leave withA wording, reference evidence, requested correction and remaining-classification sheet.

Start with the practical section

Which possible clerical discrepancy have you identified?

Identify the exact judgment passage and matching file evidence. CPC 462 concerns clerical errors and omissions within its framework, without reopening decided rights. Describe the discrepancy before giving it that classification.

  • Judgment passage and reference.
  • File evidence and matching passage.
  • Requested correction and classification question.

How do correction, failure to decide and appeal differ?

A copying error, undecided request and disagreement on merits need different checks. Clerical correction is not a disguised appeal. Failure to decide falls within a distinct framework including CPC 463.

How do you reconcile judgment and reference evidence?

The builder organises a nonpersonal evidence reference, discrepancy and correction for examination. It does not automatically read a real judgment or certify CPC 462. A change to merits or an undecided request goes to a different analysis.

Judgment discrepancy sheet

Use fictional or nonpersonal references without copying a sensitive judgment.

Local note for examination. No automatic interpretation, CPC 462 certification or filed request.

What does a differently copied number show?

The fictional evidence number contains a different digit from the reference document. Check that correction matches the file without changing the meaning of decided rights. Reconciliation documents a question; it does not alone establish clerical character.

Worked example · fictional facts

Fictional example: a document number is copied with one different digit while the reference exhibit is identified. The sheet records the discrepancy and requested correction without certifying Article 462 applies.

Which documents support the prepared request?

Prepare complete decision, reference evidence, relevant passage and requested correction. Identify the court that delivered the judgment or the court reviewing it under the applicable framework. Request and adversarial examination have their own arrangements; this page files nothing.

Why cannot correction reopen the judgment's merits?

Clerical correction repairs within its scope; it does not guarantee reopening every remedy period. If a merits challenge is contemplated, promptly have its timetable checked separately without waiting for an answer to the draft note.

What else should you check?

Is disagreement with the awarded amount always a clerical error?

No. Disagreement with valuation can concern the merits. Distinguish transcription error from a challenged decision.

Does an undecided claim necessarily use Article 462?

No. Failure to rule has a separate framework including CPC 463. Identify request and decision before selecting a route.

Must the error be reconciled with the case file?

Yes. CPC 462 refers to what the file reveals. A desired correction without evidence can leave classification unknown.

Does the organiser submit the request to the registry?

No. It assembles a local examination note without sending or filing it.

Does correction automatically reopen every appeal period?

No. Remedy effects require examination within their framework. Do not assume every period starts again.
