Civil-party compensation in France: prepare your claim
Informational guide. An independent qualified legal review has not been completed.
Joining criminal proceedings as a civil party allows a request to compensate loss connected to the offence, subject to applicable conditions. Prepare a quantified claim and evidence for each item; the amount requested is not the amount awarded. Identify the procedural stage, submission method and representation. This preparation is separate from an initial complaint and does not guarantee compensation.

What you leave withA claimed-loss, amount, factual connection, evidence and unknowns matrix for preparation.
Start with the practical sectionAt which stage are you preparing the civil-party claim?
This guide prepares a civil-party claim in an existing criminal case. Identify hearing, status, procedure and joining arrangements. An initial complaint and compensation request at this stage are not automatically the same act.

Which losses and factual connections should you describe?
For each loss, explain facts, damage, connection to the prosecuted offence and requested amount. Keep items distinct to avoid double counting. Nonpecuniary loss needs its own presentation; procedural costs differ from the value of damaged property.
| Item | Evidence or explanation | Limit |
|---|---|---|
| Material | Invoice, repair or documented value | Do not count the same property twice |
| Financial loss | Evidence and period | Connection to facts to establish |
| Nonpecuniary | Separate grounds and request | Not automatically calculated from an invoice |
| Procedural costs | Own basis and evidence | Separate from damage |

How do you connect each amount to evidence?
The matrix adds two stated separate items and flags missing evidence or connections. It does not automatically value nonpecuniary loss or procedural costs. Amounts remain requests; the tool sends nothing to the court.

What does a separate €600 and €300 claim show?
The fictional €600 property item and €300 separate financial loss total €900 requested. If the €300 covers a loss already included in €600, revise the sum. Each item should keep its evidence reference and connection to events.
Fictional example: €600 damaged property and a separate documented €300 loss give €900 requested. This is not the court's valuation; each item needs its connection and evidence without duplication.

Which submission rules and timing need checking?
Check joining method, recipient, evidence and timing for the actual stage. Written prehearing requests under CPP 420-1 include arrival at least twenty-four hours before the hearing. The text also addresses actual court knowledge before submissions on the merits despite late arrival. Have that exception and evidence checked; this is not a universal period for every way of joining.

Why does the requested total not predict the decision?
The court examines request and evidence. Undocumented amounts are not automatically awarded, and compensation must remain linked to retained losses. Prepare a numbered exhibit list and have requests, admissibility and timing checked before sending; Julie replaces neither review nor filing.
- Item, amount and numbered evidence.
- Connection to facts and no double count.
- Request, arrangements and transmission proof.

What else should you check?
Are an initial complaint and joining at trial always the same step?
No. A complaint and joining with a hearing claim can be different stages. Identify the existing procedure.
Should non-material harm be presented like an invoice?
No. Describe and present it within its framework without automatically reducing it to an invoice or invented tariff.
Is an unsupported amount automatically awarded?
No. The court examines evidence and factual connection. Entering a sum does not establish compensation entitlement.
Are procedural costs the same as the underlying loss?
Distinguish them. Procedural costs have their own grounds and requests; do not add them unclassified to the same loss.
Does the organiser send the claim to court?
No. It prepares a total and evidence questions without sending a form or request to court.
