Weed and other drug fines in France: the 2026 amount, deadlines and how to contest
Since 20 August 2026, the French fixed fine for using cannabis (weed) or another drug, the amende forfaitaire délictuelle, is 500 euros, reduced to 400 euros if paid within 15 days and raised to 1,000 euros after 45 days (Public Health Code, article L3421-1). For earlier facts, the old 200 euro amount applies. You can contest it within 45 days with a requête en exonération, together with a deposit of the same amount.

What changed on 20 August 2026?
The fixed fine for drug use (amende forfaitaire délictuelle) enters the Public Health Code: 200 euros, 150 euros reduced, 450 euros increased, including for repeat offenders. These amounts stay in force until 19 August 2026.

The Conseil d’État annuls the general ban on selling raw hemp flowers and leaves: CBD with no more than 0.30 % THC can again be sold in that form.

Law no. 2026-798 raises the fine to 500 euros, 400 euros reduced and 1,000 euros increased. It puts the fine on the bulletin n° 2 criminal-record extract for 3 years and lets a court suspend a driving licence on conviction for simple use.

How much is the French drug fine, depending on when it happened?
The amount depends on the date of the facts, not the date of the notice: for facts from 20 August 2026 the French drug fine is 500 euros, 400 euros if paid within 15 days and 1,000 euros after 45 days; for earlier facts it stays at 200, 150 or 450 euros.
This follows article 112-1 of the French Criminal Code (Code pénal): only the penalties in force on the day of the facts can apply. Use recorded on 10 August 2026 and notified in September therefore costs 200 euros. The 15 and 45 day periods run from the police check, or from the date the notice was sent if it was posted later (article 495-18 of the Code of Criminal Procedure).
According to the Public Health Code, drug use remains an offence (délit) punishable by one year in prison and a 3,750 euro fine. The fixed fine is an alternative: paying it ends the prosecution.

Should you pay or contest a French drug fine?
Pay if the facts and the amount are right; contest only with a precise argument, because contesting needs a deposit of the same amount and can lead to a trial.
Payment ends the prosecution (action publique): the case is closed, but the fine goes on your French criminal record (article 768 of the Code of Criminal Procedure) and can no longer be contested. A request for exemption (requête en exonération) must be sent within 45 days, by registered post, on the form attached to the notice (articles 495-18 and 495-20). The prosecutor can drop the case, take you to court, or declare the request inadmissible. If convicted, the fine cannot be lower than the fixed amount, unless the court gives specific reasons (article 495-21).
According to the Cour des comptes (hearing of 15 April 2026), contests of drug fines rose 49-fold between 2021 and 2024. Solid grounds are factual:
- the product was CBD with 0.30 % THC or less, with proof;
- you were not the person fined (identity theft, with a police complaint receipt);
- you were a minor, or another offence that cannot be fined on the spot was recorded at the same time (article 495-17).

Does a French drug fine go on your criminal record?
Yes: a paid French drug fine is entered on the national criminal record (casier judiciaire), and since 20 August 2026 it also appears on the bulletin n° 2 extract for 3 years.
Article 768 (11°) of the Code of Criminal Procedure records the fine once it is paid, or once the deadline to challenge the increased fine has passed. The entry is removed after 3 years if, in that time, you have no criminal conviction and no new fixed fine for an offence (article 769, 11°).
The bulletin n° 2 is the extract seen by some public bodies and employers, for instance for regulated jobs. Before 20 August 2026 fixed fines were kept off it; article 775 (17°) now keeps them off only 3 years after payment. You can ask a court to remove the entry from the bulletin n° 2 (article 775-1). At its hearing of 15 April 2026, the Cour des comptes said the recording of these fines on the criminal record was not yet working technically. The French record is national: these rules do not decide what your own country’s authorities record.

Is CBD legal in France, and what if you were fined for CBD?
CBD is legal in France if it comes from authorised hemp varieties and contains no more than 0.30 % THC; above that, the product is treated as cannabis.
The order (arrêté) of 30 December 2021 sets this 0.30 % limit for plants, extracts and products containing them. On 29 December 2022, the Conseil d’État annulled the ban on raw flowers and leaves, finding that CBD has no psychotropic effect and that its THC content can be checked with quick tests.
If you were fined for CBD, do not pay: payment closes the case and goes on the record. File a request for exemption within 45 days with the invoice, the packaging, the batch’s lab certificate and, if possible, the seized product or its reference. The deposit of 500 euros (200 euros for facts before 20 August 2026) is refunded if the case is dropped or you are acquitted (article 495-21).

What does article L3421-1 of the French Public Health Code say?
In plain English: Using an illegal drug is an offence punishable by one year in prison and a 3,750 euro fine. Prosecution can be ended by paying a fixed fine of 500 euros, reduced to 400 or raised to 1,000 depending on when you pay, even for repeat offenders.
These amounts apply to facts from 20 August 2026; before, the fine was 200 euros.
What if you only receive the increased-fine notice?
If you only receive the increased-fine notice, you can file a reasoned complaint (réclamation motivée) within 30 days of it being sent; this cancels the enforcement order and sends the case back to the prosecutor.
Article 495-19 of the Code of Criminal Procedure adds that the complaint stays admissible until the penalty is time-barred if there is no proof that you knew of the increased fine, for example through a seizure. Send it by registered post with acknowledgement of receipt, on the attached form, with a deposit equal to the increased fine: 1,000 euros for facts from 20 August 2026 (article 495-20).
If you do not dispute the facts but cannot pay, write to the public accountant named on the notice. They can grant time or a partial or total remission, possibly with a 20 % reduction (article 495-24). According to the French public finances directorate (DGFiP, answer published 3 June 2025), 126,535 increased drug fines were passed to it for collection in 2024.

Repeat offences, minors, licences, living abroad: what does French law say about drug fines?
Can you be fined on the spot again if you were fined before?
Yes, the French fixed fine for drug use can be issued to a repeat offender: article L3421-1 of the Public Health Code says so expressly, as an exception to article 495-17 of the Code of Criminal Procedure. The police are not obliged to use it; the prosecutor can also take the case to court instead.

Can a minor get an on-the-spot drug fine in France?
No, a minor cannot receive the French fixed fine for drug use: article 495-17 of the Code of Criminal Procedure excludes this procedure for offences committed by minors. A minor who received such a notice has a ground for a request for exemption, with an identity document showing their age on the date of the facts.

Can you lose your driving licence for drug use without driving?
Yes, since 20 August 2026 a French court that convicts someone of drug use can suspend their driving licence for up to 3 years, without suspension of sentence, even if they were not driving (article L3421-7 of the Public Health Code). Paying the fixed fine ends the prosecution, so there is no conviction and no suspension.

What if you cannot pay the increased fine?
If you cannot pay an increased French drug fine and do not dispute the facts, send a reasoned request to the public accountant (comptable public) named on the notice. They can grant time to pay or a partial or total remission, possibly with a 20 % reduction (article 495-24 of the Code of Criminal Procedure). No deposit is needed for this request.
How long do you have to pay if you live outside France?
A person living outside France who receives the drug-fine notice at that address gets one extra month to pay, after the 45 day period or the 30 day period of the increased fine. Paying online adds 15 more days (article D45-9 of the French Code of Criminal Procedure). The deadline to contest is not extended.
