Assisted witness or mise en examen in France?
Témoin assisté and mise en examen are distinct statuses in French judicial investigation. Mise en examen requires, among other matters, serious or corroborating indications and the prescribed safeguards. An assisted witness has defence rights and cannot be placed under judicial supervision or pretrial detention while retaining that status. It can change through the statutory process; neither label establishes guilt or an AI-determined assessment of the evidence.

How do an ordinary witness, assisted witness and mise en examen differ?
Ordinary witness, assisted witness and mise en examen have different frameworks and rights. Assisted-witness status does not remove defence rights; formal examination does not mean conviction.
| Status to identify | Reading point | Do not infer |
|---|---|---|
| Ordinary witness | Capacity and interview framework | Current status from one old letter |
| Assisted witness | Specific defence rights and regime | No rights or permanent immunity |
| Mise en examen | Threshold and procedural safeguards | Established guilt |

Which document identifies the investigation status?
Read status from current procedural acts and notifications. An old summons or recollection of an interview does not establish the position after another appearance.
Identify document date, type and what was notified. This guide infers neither guilt nor current status from a narrative entered in Julie.

Which threshold and safeguards govern mise en examen?
Mise en examen requires serious or concordant indications making the prescribed participation plausible, with CPP Article 80-1 safeguards. ‘Or’ must not become a general requirement for both criteria together.
The judge also considers assisted-witness treatment under that framework. A public table cannot assess actual case indications or decide that the threshold is met.

Which counsel and file-access rights matter?
An assisted witness has counsel, prescribed interview information and file access within Code conditions. Identify interpretation needs and applicable safeguards.
Initial appearance and declaration, answer or silence rights also have their textual framework. Prepare questions with counsel rather than deriving a strategy from a status label.

How do file consultation, copies and dissemination differ?
Consulting a file, obtaining copies and communicating them are different operations. Article 114 regulates rights and conditions; receiving a copy does not grant unrestricted publication.
Ask counsel about the relevant document’s treatment. Defence access does not turn an investigation file into a public document.

Which measures are incompatible with assisted-witness status?
While assisted-witness status continues, the text excludes judicial supervision, electronically monitored house arrest, pretrial detention and referral to trial under that status.
That does not prevent every future change. Distinguish established current status from a later procedurally valid mise en examen.

How can a status change occur?
Article 113-8 provides transition to mise en examen when required indications emerge, through prescribed interview or notification arrangements. Establish change from acts rather than assumptions.
New information may require rereading rights and obligations with counsel. This guide predicts no status change in an individual case.

Does an earlier summons establish the current status?
The fictional summons and earlier notice do not establish the latest appearance’s outcome. Current status remains a question for counsel.
Do not prefer an older document merely because its label sounds reassuring. The example classifies neither guilt nor permitted measures.
Fictional file: a summons and an earlier notice are available, but no document establishes the latest appearance’s outcome. Current status remains a question for counsel; the comparison infers neither guilt nor permission for a measure.

Which questions should be prepared for counsel before the interview?
Useful questions concern the current act, interview framework, counsel and file access. A readable collection preserves records without unnecessary circulation.
- Which act establishes status after the latest step?
- How is counsel notified and summoned?
- Which consultation or copy arrangements apply?
- What change was actually notified and when?

What else should you check?
Must indications be both serious and corroborating?
No. The provision uses serious or concordant indications with its other safeguards. Replacing ‘or’ with ‘and’ changes the legal condition.

Does an assisted witness lack defence rights?
No. Assisted witnesses have specific rights, including counsel and file access within scope. They should not be treated as witnesses without those safeguards.

Does the status permanently prevent a later change?
No. Status can change under the prescribed process and indications. Read current acts rather than assuming permanent protection.

Is counsel’s notice period the same as file-availability timing?
No. Counsel notice and file availability have distinct rules. Identify acts, periods and units under the applicable framework.

Can investigation-file copies be shared freely?
No. Consultation, copying and communication have different conditions. Defence access does not make copies freely publishable.
