European payment orders: applying from France
A European payment order concerns certain quantified, due monetary claims in cross-border civil or commercial disputes between participating states. Denmark is excluded. Form A requires jurisdiction, the claim’s basis and cross-border character to be established. The defendant can oppose within thirty days of service or notification. This is neither a French domestic payment order nor a guarantee of recovery.

How can you prepare scope, jurisdiction and form amounts?
The worksheet distinguishes creditor and defendant. The euro total is an arithmetic example, not a decision on jurisdiction or the debt’s merits.

Prepare form A: claim, basis, evidence description, jurisdiction and cross-border character, then check national transmission arrangements.
- Entered arithmetic total
- €2100.00
- Identify parties, domiciles, court and civil or commercial scope.
- Connect principal, interest and costs to their basis and supporting evidence.
- Use the appropriate official form: A for the application, F for opposition.
- Keep evidence of transmission, service and court responses.
Fictional euro example. The total creates neither jurisdiction nor an established debt; the issuance period is not a payment promise.
Which claims and states fall within the European procedure?
Regulation 1896/2006 concerns qualifying quantified, due monetary claims in civil and commercial matters with cross-border character assessed when applying. At least one party must reside or be domiciled in a participating State other than the seized court. Denmark is excluded; tax, insolvency, succession and other specified subjects are outside scope. A foreign invoice alone is insufficient.

Can the creditor’s French court automatically be used?
No. Jurisdiction must be established under the applicable rules and Regulation. For a defendant consumer protected by article 6, competent courts are in the State of that consumer’s domicile. Establish status, domiciles, contractual purpose and proposed court before completing the form’s jurisdiction section.

What belongs in application form A?
Form A identifies, in particular, court, parties, principal, interest and costs, the claim’s basis, evidence description and cross-border character. Separate the amount sought from its supporting basis: a total does not establish entitlement. Check currency and transmission methods accepted in the relevant State and court.

Does the thirty-day issuance period guarantee payment?
No. The Regulation provides issuance as soon as possible, in principle within thirty days, excluding the applicant’s time to complete, correct or modify. Rejection, opposition, adversarial proceedings or enforcement difficulties may follow. An indicative issuance timetable is not a funds-recovery deadline.

What does the governing text say about a european payment order?
L'opposition est envoyée dans un délai de trente jours à compter de la signification ou de la notification de l'injonction au défendeur.
In plain English: The Regulation provides opposition within thirty days of service or notification of the order. Scope, jurisdiction and the consequences for proceedings or enforcement require separate examination.
What follows opposition or its absence?
The defendant sends opposition to the originating court within thirty days of service or notification without having to give reasons. Continuation depends on creditor choices and available procedures under the current article 17. Without timely opposition, the court checks conditions before declaring enforceability; enforcement then follows national rules without automatic collection.

Does a 5,000-euro limit apply to European payment orders?
