Disputing a private-document signature in France

When attributed private writing or a signature is denied, the French judge verifies it unless the case can be decided without it. The procedure may use originals, comparisons, personal appearance or investigative measures; expert examination is not automatic. Electronic signatures are assessed under their own legal validity conditions. AI cannot authenticate a signature from a scan’s appearance.

Is a disputed electronic signature simply a handwriting comparison?

No. Article 287 refers to Civil Code articles 1366 and 1367’s validity conditions. The process, identification and validity evidence need examination within that framework, not just the visible signature shape.

Answer

When does the court verify disputed private writing?

Article 287 covers denied writing or signature and unrecognised writing of an alleged author. The court verifies it unless able to decide without relying on it. Place the document within the claims and other evidence. A signature dispute does not require every unrelated issue in the case to stop.

How can you prepare evidence without deciding authenticity?

Classify the writing and available material. The worksheet organises documents and the route for review without analysing a signature’s shape.

Preserve the copy unaltered and seek the original. Comparison material and the writing’s relevance are assessed within the procedure.

Material to preserve
Disputed contract, original to request and comparison documents
  1. Preserve the received original or copy and its provenance without alteration.
  2. Distinguish private writing, authentic instrument and electronic signature.
  3. Identify comparison documents and people who saw signing without creating artificial samples.
  4. Have the writing’s role in the dispute and the procedural route examined by the adviser.

This worksheet neither compares signatures nor detects forgery. Verification belongs to the court and any investigative measures it orders.

Answer

Which comparison documents may assist the court?

The court uses available material and may order comparison documents or samples under procedural control. Useful documents need not have been created when the disputed act was made. Identify provenance, date, alleged author and available original without manufacturing material to make a comparison appear stronger.

The law

What does the governing text say about signature verification?

le juge vérifie l'écrit contesté à moins qu'il ne puisse statuer sans en tenir compte.

Code de procédure civile : article 287In force since 1 October 2016Read on Légifrance

In plain English: Article 287 provides for judicial verification where the decision depends on disputed writing. Comparisons and investigative measures occur within that framework; AI visual recognition is not a substitute.

Answer

Is handwriting expertise always required?

No. The judge may order personal appearance, hear people who saw writing or signing and take useful measures, including technical assistance where needed. The choice depends on the file. A software similarity score or visual comparison of scans does not replace that judicial assessment.

Answer

How should originals and third-party documents be preserved?

The procedure provides for deposit, preservation and access to disputed and comparison material. The court can organise production of third-party documents with necessary safeguards. Preserve received files and their transmission unaltered; seek the original rather than inferring authenticity or worthlessness from scan quality alone.

Answer

Why distinguish an incident in a case from a principal verification claim?

Verification can arise within a dispute relying on the writing or through a principal claim. In the latter, personal service and nonappearance have specific effects; without personal service the verification rules still apply. Do not copy a denial formula without identifying the document received and procedure started.

Frequent questions

What else should you know about signature verification?

Can denying a signature later judicially established carry a sanction?

If the document is judicially found written or signed by the person who denied it, article 295 provides a civil fine up to 10,000 euros, without prejudice to damages. The finding is judicial, not a tool’s opinion.

Does a disputed notarised instrument use this same private-writing route?

This page concerns private writing. An authentic instrument follows another challenge framework, including the forgery procedure. Establish the document’s legal nature before choosing a model or judge.

Does a poor-quality copy prove the signature is false?

No. Legibility and authenticity are different issues. Preserve the copy, seek the original and record its limitations. Assessment uses evidence and measures within the procedure.
