Claiming up to 5,000 € in France: which amicable step comes before court?
For a French civil payment claim of up to 5,000 €, an attempted settlement through a court conciliator, mediation or a participative procedure is generally required before filing. Article 750-1 also covers specified neighbourhood actions and abnormal neighbourhood disturbance. Exceptions require evidence; an ordinary demand letter is not automatically enough. Which route fits my dispute and budget?
A free conciliator is one route. Consumer mediation has its own admission conditions; not every mediator charges the consumer.

When does the preliminary step apply?
It generally applies to payment claims up to and including 5,000 €, and the neighbourhood actions specified in article 750-1. The provision includes abnormal neighbourhood disturbance. It does not turn every disagreement between neighbours into the same procedural claim.
Is a demand letter enough?
An ordinary demand letter does not automatically replace conciliation, mediation or a participative procedure. Article 750-1 names those three routes. Keep the third party’s response and records showing what happened after you contacted them.
Which exemptions can I establish?
The article covers approval of an agreement, certain required preliminary procedures, legitimate grounds and a failed simplified small-debt recovery procedure. Manifest urgency is one legitimate ground. Another is a first conciliator meeting more than three months after referral; evidence of referral and its outcome is required.
How do I approach a conciliator?
Use the official directory or ask a point-justice legal access desk, town hall or court. A conciliateur de justice is free. Prepare the other party’s details, your requested amount and the documents supporting it.
What if the other party refuses to attend?
Ask the conciliator for a record of the attempt and its unsuccessful outcome, then keep it with your court documents. You need evidence of a real attempt. Simply asserting that the other party would have refused is a different situation.
How do I file after the attempt fails?
Check the correct court, then use the appropriate application or summons with evidence of the attempt or exemption. Article 818 permits a requête, a court application, for claims not exceeding 5,000 €. Court jurisdiction and lawyer requirements need separate checks.
Does asking for conciliation stop a limitation period?
Suspension depends on article 2238. An ordinary letter does not suspend every deadline. The start can depend on a written agreement to use the process or, without one, the first meeting. Have any approaching deadline checked independently.
Does every mediator charge a fee?
No. Consumer mediation is free for the consumer; other mediation may involve agreed fees. Check the named mediator’s scope and admission conditions. A participative procedure requires each party to have a lawyer.
Is this the European small-claims procedure?
No. The European procedure is a separate route for qualifying cross-border claims. It also has a 5,000 € ceiling, excluding interest and expenses. Check its territorial scope, subject exclusions and the competent court.
